General Terms and Conditions for Donations

These General Terms and Conditions for Donations (hereinafter the “GTCD”) apply between TRIAL International, a Swiss-law association (hereinafter “TRIAL International”), and a natural or legal person (hereinafter “Donor”), through the website accessible at https://www.trialinternational.org (hereinafter the “Website”).
The GTCD apply in their version in force at the date of the donation, made via the Website.
The GTCD and the General Terms of Use (hereinafter the “GTU”) of the Website apply exclusively. The Donor expressly and unconditionally accepts the GTCD and the GTU by proceeding with the transfer of their donation.
In the event that a User of the Website decides to create a Campaign or participates in a third-party Campaign in the form of a donation, they undertake to be of legal age. TRIAL International declines all liability if a minor were to make a donation or create a Campaign without the consent of their parents or the person holding parental authority over them.
In the case of a Donor that is a legal person bound by its own general terms and conditions, if these are contrary to or diverge from the GTCD, they will not be recognised, except in the event of express and unequivocal written consent from TRIAL International, in that individual and specific case.
TRIAL International reserves the right to modify these GTCD at any time.
ARTICLE 1 – DEFINITIONS
For the purposes of the GTCD, the following terms have the meaning assigned to them:
Campaign(s): Refers to any promotional campaign created by a Donor to raise funds in support of one of TRIAL International’s activities.
Donor(s): Natural or legal persons making one-off or monthly donations on the Website.
User(s): Refers to any person accessing and using the Website.
ARTICLE 2 – PAYMENT METHODS
TRIAL International accepts the following payment methods:
- Credit card: Mastercard, Visa
- Twint
- Google Pay
- Apple Pay
- QR-Invoice

- Bank transfer
Any Donor is free to organise their own Campaign via the Website.
ARTICLE 3 – SUBJECT MATTER AND CONCLUSION OF CONTRACT
Any donation made by the Donor is binding on the Donor and TRIAL International, whether the donation is one-off or monthly.
The Donor is free to choose the amount of the donation they wish to make, and is deemed to have accepted these GTCD upon making their donation.
The contract relating to the donation is concluded as soon as the transfer is credited to a bank account of TRIAL International.
Specific case of a monthly donation: When the Donor agrees to a monthly donation, they will be debited every month via the payment method provided when the donation was set up.
Specific case of a donation by QR-Invoice: The Donor is free to choose the amount of the donation they wish to make if they use a QR-Invoice without a predefined amount. However, if the Donor uses a QR-Invoice with a predefined amount, they must transfer the amount stated.
Withdrawal by the Donor: The Donor may withdraw at any time. The Donor must notify their withdrawal by email, telephone, or registered mail, no later than 31 December of the current year in which the donation was made, in accordance with the information in Article 8 – Contact. It is specified that for a withdrawal made by registered mail, the date of withdrawal is the date on which the registered mail is received by TRIAL International.
ARTICLE 4 – USE OF DONATIONS
TRIAL International is in principle entitled to use donations freely within the framework of its mission to fight impunity for international crimes and support victims in their quest for justice (unrestricted donations). TRIAL International is recognised as a public benefit organisation and is tax-exempt in the canton of Geneva.
It is specified that a donation confers no right to support specific projects or any other claims by the Donor.
If the Donor makes a donation on the Website via a page on which a specific donation purpose is indicated (for example a project, programme or thematic campaign), TRIAL International will use the donation as described on that page (restricted donations).
ARTICLE 5 – CORRECTION OF INPUT ERRORS
Input errors that may occur when manually entering a donation amount must be reported after being identified before the end of the current fiscal year. The possibility of correcting input errors expires on 31 December of the current fiscal year in which the donation was received.
The Donor must submit the correction request by email, telephone, or registered mail, in accordance with the information in Article 8 – Contact.
ARTICLE 6 – TAXES AND LEVIES
In accordance with applicable Swiss tax legislation, donations to TRIAL International are tax-deductible under certain conditions, TRIAL International being recognised as a public benefit organisation and tax-exempt in the canton of Geneva. TRIAL International does not, however, guarantee the tax-deductibility of donations in all cantons. A potential absence of deductibility does not give rise to the right to cancel donations that have been made.
Donors will receive a donation certificate from TRIAL International at the beginning of the following year.
ARTICLE 7 – PERSONAL DATA
Making a donation requires the Donor to provide personal data, such as their contact details or bank details. This data, necessary for the transaction, is stored in compliance with applicable regulations.
The rules and conditions under which TRIAL International collects and processes this data, as well as the extent of Donors’ rights, are set out in the Privacy Policy accessible on the Website.

ARTICLE 9 – APPLICABLE LAW AND JURISDICTION
Swiss law applies exclusively to these GTCD. The application of conflict of laws rules is excluded.
The exclusive place of jurisdiction for any claims relating to donations is the registered office of TRIAL International in Geneva. The invalidity of certain provisions does not affect the remaining validity of these GTCD.
